The purpose of this document is to provide an agreement for the MEP Engineer to use when transferring digital data files to another party. This agreement features:

  • A Letter Agreement
  • Appendix A for listing documents to be released


The Contractor’s use of the engineer’s digital data files presents some of the same liability concerns traditionally associated with using reproductions of the engineer’s drawings for preparation of shop drawings. The use of BIM files to generate material take-offs or to use for coordination or clash detection with other trades could result in additional liability. These issues are in addition to the usual issues associated with electronic data transfer, such as compatibility of hardware or software, accidental file modification, media degradation, etc.
