CASE #7: An Agreement for Structural Peer Review Services

A request to perform a peer review of another structural engineer’s design brings with it a different responsibility than that of the Structural Engineer of Record. The CASE #7 document addresses the responsibilities and the limitations of performing a peer review. This service is typically performed for an Owner but may be altered to provide peer review services to others.

As of 2019, the document was legally reviewed and the following changes were made:

1. What’s New:

  • Termination provision
  • State-by-state drafting questions and considerations

What’s Updated:

  • Clarified insurance obligations
  • Modified indemnity provisions
  • Limitation of liability provisions
  • Dispute resolution provisions

A companion document to this Contract is CASE 962-G: Guidelines for Performing Project Specific Peer Reviews on Structural Projects

***Updated in November 2021 to include a Force Majeure clause.
